By placing an order through our website or by accepting an offer made by us you will thereby accept these terms and conditions. Any changes or differences to these terms are only valid after a written confirmation or approval of PimpYourKitchen.co.nz, in which case all other terms will remain valid. Our terms and conditions respect the consumers’ rights as stated by law.
Product DescriptionsEvery effort is taken to ensure that all descriptions, sizes and prices are accurate at the time of publication on PimpYourKitchen.co.nz.
Illustrations of goods for sale should be treated as examples only. All of our items are custom made and may differ slightly from the pictures that you see on the site. Additionally, colours may vary from those in the illustrations through your own monitor, printer and video settings.
We do assume that by placing an order on our website, and thereby agreeing to these conditions, you have familiarized yourself with the information on the website regarding the product material and how it should be applied to the back wall.
Prices, Invoice and PaymentAlthough we try to ensure that all prices are accurate, errors may occur. If we discover an error in the price of your order, we will notify you as soon as possible. You will have the option of reconfirming your order at the correct price or canceling. If we are unable to contact you we will refund you in full. We reserve the right to change our prices without notice.
All prices are quoted in pounds sterling and are excluded of GST and include shipping to the NZ or Australia by our choice of secure shipment.
Upon completion of your order an invoice is sent to the provided e-mailaddress which can be printed for your administration.
Payment can be made by use of Paypal.
Your OrderWe accept orders at our discretion. It is your responsibility to ensure that the details you give are correct and complete. After placing your order an automated order confirmation is sent to the given e-mailaddress. If in any case we are unable to accept your order we will notify you by sending an e-mail to that same address within 5 days.
DeliveryWe will deliver the goods to the address you provide on the order form. We will only deliver to a NZ or Australian address.
Any delivery date we give is an estimate.
Unless the delay is longer than 30 days from the date we confirm your order, you cannot cancel the contract. If we are unable to deliver within 30 days of completing the order, we will notify you and will inform you of the right to cancel your order, free of charge.
If we can’t deliver the goods because you won’t accept delivery, you haven’t provided the correct address, or no-one is available to accept delivery, then: all risk in the goods will pass to you.
We shall not be liable for any proven non-delivery unless you report it within 7 days of the date when the goods should have arrived.
Our liability for non-delivery is limited to replacing the goods within a reasonable time, or issuing a credit note.
Defects and ReturnsWe will not be liable for any defects of the goods unless: You tell us of the defect within 7 days of the time you discover, or ought to have discovered, the defect; and we are given a reasonable opportunity, of examining the goods and, if requested, you return the goods to us at your expense for examination (If we
agree that the goods are defective, we will refund this expense).
We shall not be liable for any defect if: You use the goods after telling us about the defect; or the defect arises through misuse, or inappropriate storage, of the goods; or you alter or repair the goods without our written consent.
All our goods are custom made to your order’s specifications. Custom made products are excluded from the cancellation rights policy as stated by the DSR Regulations. That means that a 7 day cooling-off period after receiving the goods does not apply in this case. Any questions concerning the product material, or use of the product should be asked before placing an order, or atleast before the goods are produced in your name.
This does not affect your statutory rights.
Use and SafetyOur splashbacks can be used as a decoration for your kitchen back wall. The material is a plastic/synthetic material. When used behind a hob some caution is advised. You need to make sure that the heat doesn’t build up excessively and that hot pans and flames cannot reach the splashback. To protect the splashback from the cooker there are backboardsavers available at your local kitchen supplier.
Limitation of LiabilityPimpYourKitchen.co.nz will not accept liability for loss, damage, death or personal injury caused as a result of improper or inappropriate use of any of its products. Any other use is undertaken solely at your own risk.
Subject to any relevant consumer protection legislation including our obligation under the Consumer Protection (Distance Selling Regulations) and the Unfair Contract Terms Act 1977 our liability for any breach of the terms of this agreement, whether express or implied and whether concerning the description and quality of any goods supplied by us or our performance in supplying and delivering such goods to you will be limited to the value of the goods ordered by you in the relevant transaction.
If any of the foregoing limitations of liability are found by a Court of competent jurisdiction to be void or unenforceable, the validity of the remainder of these terms and conditions shall not be affected and such remainder shall apply as if the void or unenforceable part were not included with such modifications as may be necessary to give full force and effect to them.
Force MajeureWhere there is a delay or failure to deliver goods, or where damage or defect has occurred to goods that is due to circumstances beyond our control, PimpYourKitchen.co.nz shall not be liable. This condition does not affect your statutory rights.
CopyrightThe content of this website is exclusively owned and controlled by PimpYourKitchen.co.nz. You are not permitted to reproduce, adapt or store in any medium, any part of its content, nor is it permissible to use tools or other methods for the purpose of data gathering, mining or extraction by any means without written permission from PimpYourKitchen.co.nz.

Changes to Terms and Conditions and websitePimpYourKitchen.co.nz reserves the right to make changes to their Terms and Conditions and their website. By placing an order on the website, you accept these Terms and Conditions and will be subject to those in force at the time of your order. If for any reason any of these Terms and Conditions is deemed invalid, void or unenforceable, the validity and enforceability of any remaining condition shall not be affected.
GeneralEach of our rights or remedies under the Contract is without prejudice to any of our other rights and remedies whether under the Contract or not.
If any provision of the Contract is found to be wholly or partly illegal, void, voidable, unenforceable or unreasonable, then it shall be deemed severable. The remainder of that provision and the remaining provisions shall continue in full force and effect.
Any failure or delay by us in enforcing any part of the Contract will not be taken as a waiver of any of our rights.
If we ignore any breach of any part of the Contract by you, this does not mean that we will allow any further breach and it will not affect the other terms of the Contract.
The Contract is governed by Dutch law and the parties submit to the exclusive jurisdiction of the Dutch courts.
Nothing in these Conditions shall create any rights for third parties under the Contracts (Rights of Third Parties) Act 1999.
